Set-Back Engineer Seniority Restriction 11 and 4

If set-back engineer was forced to work as an Engineer and would/should have been picked up as an engineer, but was not due to seniority restriction:

Your claims:

• When set back Engineer is forced to work as an Engineer and you were not added to the Engineers extra board.
• Claim is for a seven basic days for CMS Mishandling/seniority restriction.

Documentation:

• A copy of the applicable engineer seniority roster showing your ranking.
• A copy of the board snapshot in seniority order.
• A copy of your JOB HISTORY showing what you were actually working on the date the Claim is being made
• If claiming difference in earnings, must include a copy of your e-payroll recap with notes demonstrating the amount actually made for the date range being claimed vs. what you would have made as an engineer had you been properly picked up.

Claiming 7 days at the Engineer’s Guarantee Rate of pay from (date to date). On (date) at (time) hrs. I was forced to work as an Engineer when holding a position as trainman on the (Circ 7) (Board). Per the BLE Engineers Extra Board Agreement Item 9 Regulation, Engineers added to the extra board shall not be removed therefrom for a period of 7 days.

If a set-back Engineer was used and you are senior to said Engineer and should/would have been used as an Engineer, but was not due to a seniority restriction.

• When a junior set back Engineer is forced to work as an Engineer and you were not added to the Engineers extra board.
• Claim is for a seven basic days at the Engineer rate of pay for CMS Mishandling/seniority restriction.

Claiming a basic day penalty account CMS Mishandling in restriction of my seniority. On (date) at (time) hrs. (Junior Engineer) was forced to work as an Engineer when holding a position as trainman. I am currently working as a trainman and was on the (Circ 7) (Board). Per the BLE Engineers Extra Board Agreement Item 9 Regulation, Engineers added to the extra board shall not be removed therefrom for a period of 7 days.
